Ethical issues for conveyancers in the Tranche 2 era
The extension of AML/CTF obligations to conveyancers from 1 July 2026 imposes more extensive obligations on conveyancers, some of which impact on obligations imposed under general law, other regulatory frameworks or the Rules of Conduct.
In this session Tony Cahill will review the key Rules of Conduct which cover similar ground to AML compliance, and how any potential inconsistencies might be managed. Among the issues addressed will be:
* Duties of disclosure and confidentiality and the prohibition of tipping off
* Onboarding potential clients - when should you consider declining to act?
* Offboarding an existing client mid-matter.
* What if the client's instructions or behaviour raise an AML "red flag"?
* The perils of reliance agreements between providers of designated services
* How to deal with a suspicious matter report
* Retaining evidence of verification of identity / KYC documents now that the Privacy Act 1988 (Cth) applies. |
